What is Employment Law?

Employment law governs the relationship between employers and employees. It sets out requirements and minimum standards for wages and conditions, employment contracts, workplace health and safety, paid parental leave, annual leave, long service leave, employee rights and termination requirements.

Employment Lawyers for Employers

If you’re an employer, you may need an employment lawyer to help you:

  • Prepare your initial suite of employment contracts or advise on any major employment law changes that affect your employment contracts.
  • Terminate an employee or employees, especially where you think the employee whose employment you want to terminate is senior-level or may bring a claim against you.
  • Create workplace and WHS policies and deal with WorkSafe investigations.
  • Understand your employer rights and responsibilities, navigate superannuation rules for employers and reportable employer superannuation contributions and, obtain Government incentives for employers such as a wage subsidy.
  • Manage enterprise bargaining or deal with unions or the Fair Work Commission.

Employment Lawyers for Employees

If you’re an employee who is employed on a casual, fixed term, part time or full time basis, you may need an employment lawyer:

  • To review and negotiate an employment agreement if it is a high-worth contract or you intend to leave your employer and want to get legal advice on your employee rights and responsibilities under your employment contract.
  • If you have been treated unfairly in the workplace, such as an unfair dismissal, workplace bullying or sexual harassment in the workplace.
  • If you are dealing with redundancy that is not genuine or termination of employment.

Bear in mind that the damages or payout you may receive even if you are successful in taking your employment law issue to court may not be very high. An employment lawyer will be able to assess the strength of your case and whether a negotiated settlement is a better option. Given this, employment lawyers will pre screen all clients before proceeding further.

To make the most of your first meeting with an employment lawyer, come prepared with the all relevant employment contracts, printouts of emails, any warnings, the name of your employer, your salary details and any termination or redundancy payment information.
